Nebraska (NE) Private Label Process

Real’s Private Label program allows eligible independent brokerages to keep the brands that they spent years building – while still benefiting from partnering with Real.

Getting Started:

• If your brokerage has a physical office location, kick-off the approval process by completing the Physical Office Application - Found HERE

Step 1: Are you currently using a Trade Name? Release your Trade Name 

• The Secretary of State will not approve any Trade Name applications if there is an entity name or existing trade name that is too similar. In order for Real to file the brokerage name as a Trade Name, the existing Trade Name will need to be released. 
• To release your Trade Name contact the Nebraska Secretary of State for next steps. 

Step 2: Real files the Trade Name with the Nebraska Secretary of State 

• Approval and final processing of Trade Name will take around one week.  
• Once the Trade Name is officially released, the Private Label team will file the application to have the Assumed Name added to Real. 
  • • Note: Step 1 must be fully processed in order to continue to this step. The SOS will not approve any Assumed Name for real if that name is already in use. 

Step 3: Real publishes the legal notice in the Omaha World Herald and files Affidavit of Publication with the Secretary of State

• Once the Secretary of State has provided a certified copy of the Trade Name filing, Real will partner with the Omaha World Herald to publish a legal notice stating that Real Broker NE, LLC will be operating under a new Trade Name. 
• Once the publication has ran in the Omaha World Herald once, Real will file the affidavit of publication with the SOS. 
  • • Generally, legal notice publications run within a week of the initial requesest
    • This must be filed with the Secretary of State within 45 days of the Trade Name filing/approval.
• The Omaha World Herald will send a copy of the Affidavit of Publication to the Nebraska SOS

Step 4: Real prepares and submits all of the required documentation to the Nebraska Real Estate Commission 

• The Real Private Label team will partner with the Nebraska State Designated Broker to submit all of the documentation to NREC via the online portal.
