Yes. You must always provide the ABA disclosure to your clients - and your clients must sign these disclosures.
This is an important disclosure to let them know that in addition to brokerage operations, we also have a Mortgage and Title branch.
We want everyone to be aware that we have a financial interest in these branches - and if they choose to use the mortgage or title services, this could provide a financial benefit to the brokerage.
Also, this is required to maintain compliance with the federal RESPA (Real Estate Settlement and Procedures Act) guidelines.
This disclosure should be provided to clients whether or not they chose to use our affiliated mortgage and title services. Obviously, your clients have no obligation to use these services.

Title services are not available in Oregon, only Mortgage. Do I still need to present this to my seller clients even though they would not be getting a mortgage when selling their home?
